A teenager is facing charges as a result of his role in the alleged murder of his mother's boyfriend. The 18-year-old New York man is accused of choking a 43-year-old man to death in their Bronx apartment in the early morning of Aug. 14. He has since been released on bail, and He is likely working with criminal defense counsel in advance of future court hearings.
According to the accident report, an altercation between the older man and the 37-year-old mother began around 4:30 a.m. in the hallway of her apartment building. The altercation is said to have turned violent when the man followed her into the apartment and allegedly began beating her. The 18-year-old said he heard the altercation and came out of the bedroom to protect his mother.
The teen apparently took hold of the man's neck in an attempt to remove him from his mother. The man lost consciousness and later died, but it is unclear at this time whether the teen continued to choke him after he lost consciousness. The altercation was not without precedent as the boyfriend had multiple prior charges and police had been called to the residence for domestic disputes in the past. The teen stands accused of murder.
In criminal defense cases of this type, the accused individual's representation may choose to argue that the teen was acting in defense of his mother. They may also dispute that it was the teen's actions that resulted in the man's death. In either case, the burden of proof is on New York prosecutors to prove each and every element of the murder charge in court and beyond a reasonable doubt.
