Criminal defense: Hockey scout charged with DUI in New York

A talent scout in town searching for new hockey hopefuls landed himself in hot water on the evening of Aug. 26. New York law enforcement arrested the Canadian man following an alleged DUI incident. The talent scout has likely retained criminal defense counsel to accompany him to his upcoming court proceedings, the latest of which was scheduled for Sept. 21. 

According to the police report, the scout was arrested around 11:40 p.m. after his alleged drunken exploits, which included stealing a golf cart and striking another vehicle on the premises of a New York amusement park. The man was apparently in New York scouting for the Toronto Maple Leaf hockey franchise. Spokespeople for the team have declined to comment on the current criminal investigation. 

It is unclear why officers assumed the man was drunk at the time of his arrest, as no mention of a roadside sobriety test is made in the report. However, the man now stands charged with DUI, unauthorized use of a vehicle without consent, refusing a breath test and leaving the scene of an accident, among others. If convicted, he could lose his license and possibly face jail time. 

Drunk driving cases, especially ones so bizarre, are sometimes difficult to prosecute. The burden of proof is upon New York prosecutors, who must prove beyond reasonable doubt that the man was intoxicated at the time he allegedly stole and crashed the golf cart. In the meantime, it will be the responsibility of the individual’s criminal defense representation to carefully scrutinize the evidence to determine whether due process was obeyed during the investigation and subsequent arrest.
