A 29-year-old man is dead of an apparent gunshot wound and another man has been arrested for his murder. The accused is 49 years old and was arrested by New York City Police on Sept. 30 after the victim was discovered the night before. It is unclear from the report whether the man has retained criminal defense counsel.
Police say they were called to an elevated subway line in the Bronx at some point on the night of Sept. 29. There, they discovered the 29-year-old man apparently bleeding from what appeared to be a gunshot wound to his neck. He was rushed to a local hospital, where he was pronounced dead some time later. Police conducted an investigation, and based on their findings -- which were not mentioned in the media report -- they concluded the older man was a prime suspect. He was apprehended the following day.
The man now stands charged with murder, as well as possession of a weapon. It is unclear whether the weapon was his property, or even if it was a gun. All of this information will be brought to light as the proceedings move forward in criminal court.
It will be the responsibility of New York prosecutors to prove all of the elements of the crimes charged in this case. In so doing they must prove beyond reasonable doubt that the man was criminally responsible for the murder of the younger man.
