Criminal defense: Rapper faces DUI in New York

A prominent rapper from a neighboring state is facing serious charges after being arrested the morning of Nov. 3. New York police say they have charged Fetty Wap, real name Willie Maxwell II, with DUI and a host of other driving infractions after he was pulled over for allegedly drag racing. It is unclear whether he has retained criminal defense representation at this time or if he is still in police custody.

According to police reports, the rapper was observed driving 100 miles per hour in a 50 mph zone around 1:00 a.m. Police believe he may have been racing another vehicle, but there has been no word as to whether any other drivers were also arrested. The officer on the scene asked the rapper for his identification, which was apparently an expired license from his home state.

The officer said there was reason to believe the rapper was intoxicated, so a field sobriety test was administered. Maxwell apparently failed the test and was taken into custody. He now stands charged with DUI, driving without a valid license, drag racing, reckless endangerment and several other traffic infractions. If he is found guilty, he could lose his license permanently and may also face jail time.

However, New York authorities will have to prove all of these allegations in a court of law. In order to build an effective case in support of Maxwell, criminal defense representation will review the arrest record and all evidence gathered by police on the scene. If any part of this process is found to have violated Maxwell’s rights, or if the evidence can be reasonably called into question, his defense team will build that into their case against the state.
