Criminal defense: Man accused of assaulting New York cop

Police arrested and charged a man outside of Madison Square Garden following an alleged altercation between the man and a uniformed officer. New York police say the man, who has been identified as a 26-year-old resident of the Lower East Side, has been charged with robbery and assault in connection with the case. So far, they have not announced a court date, and it is unclear if the man has retained criminal defense representation.  

According to the report, officers were called to the stadium around 10:45 a.m. the morning of Jan. 28, after a female officer radioed for support. According to the officer on the scene, she was approached by the 26-year-old man who allegedly attempted to steal her sidearm from its holster. The officer said she was able to push the man away, at which point the man fled the scene. 

The officer gave chase and suffered a laceration to her head when the man apparently threw a laptop at her. However, she was able to apprehend the suspect and arrest him. He was charged and taken to a local hospital for a psychiatric evaluation. The officer was also taken to a hospital for treatment for the injuries she sustained in the pursuit. 

In New York, criminal intent is intrinsically linked to the mental state of an accused individual. The outcome of the psychiatric evaluation may play a major role in the court case moving forward. If the man's mental stability is called into question, his criminal defense representation may be able to argue in favor of a reduced sentence, possibly in exchange for mandatory psychiatric treatment.
