Criminal defense: Teen faces manslaughter charges

A 15-year-old girl has been linked to a serious car accident, according to Nassau County authorities. The girl is facing manslaughter charges following the single-vehicle crash that claimed the life of her brother and two other teens, and injured several more. She will be tried as a juvenile in a New York court, but will still require criminal defense representation to protect her rights and pursue a favorable result.

According to the accident report, the girl took an SUV from the father of a friend without asking permission in an effort to take her friends to the beach while skipping school. Neither she nor anyone in the vehicle was licensed to drive. It appears she lost control of the vehicle near the M9 exit in Freeport, crashing the vehicle into the surrounding marshland. Several people were ejected from the SUV at this time.

The girl's brother, 13, as well as a 16-year-old and a 15-year-old were all killed in the crash. Six other teenagers, including the driver and her 18-month-old infant, were also injured in the accident. The extent of their injuries was not reported. The girl faces serious consequences if she is found responsible by the juvenile justice system. For now she is being held in a juvenile detention facility in advance of a July 3 court date.

The tragedy of the loss involved in this accident is nearly immeasurable, and the girl has been subjected to a psychiatric evaluation that suggests she is remorseful over her actions. Given the young age of the girl, it will be very important for her criminal defense team to consider both her age and her mental state in creating their defense. It is possible the girl could be tried as an adult if the court so decides, which in New York state could mean serious jail time in the event that a conviction is ultimately obtained.
