Criminal defense: woman charged with terroristic threats

| Jun 6, 2018 | Criminal Defense

A woman in upstate New York is in legal trouble after allegedly posting anti-gay threats on Facebook. New York authorities in Buffalo arrested the woman for making terroristic threats after threatening posts appeared on the Facebook page of a local gay pride parade. It is unknown whether the woman has retained criminal defense representation at this time.

According to the report, local residents notified police when threatening comments appeared on the Facebook page for the Buffalo Gay Pride Parade. The content of these comments was not made available to the media, but police say they were serious enough for them to launch an investigation. The parade was set to take place on June 3.

The 40-year-old woman was apprehended overnight on June 2, though it is unclear whether she remains in police custody at this time. She stands charged with one felony count of making a terroristic threat. However, the organizers of the parade have not come forward expressing concerns that her threats could or would be acted upon at this time. If she is found guilty, she could face several years in a state penitentiary.

With all of this said, it is often very difficult to prove the source of an anonymous online comment. This is a challenge facing many law enforcement organizations not just here in New York, but elsewhere across the nation. Prosecutors will have to provide compelling evidence that the woman did indeed post these alleged threats, while her criminal defense team will analyze that evidence in an attempt to build a strong defense in her case.
