Criminal defense: Man faces drug charges

| Aug 14, 2018 | Criminal Defense

An out-of-state man is in hot water following a traffic stop, according to local sources. New York State Police say they arrested a man for potential drug crimes on Aug. 9. If he is found guilty of the myriad charges filed against him, he could face serious jail time. It is unclear whether the man has retained criminal defense representation at this time.

Very little information is available regarding the traffic stop and subsequent arrest of the 35-year-old Lakewood resident. It has been confirmed that he was stopped by police when entering the northbound off ramp at Exit 20 around 11:45 the night of Aug. 9. This information has been provided to the public by way of the official New York State Police website. However, no details about the stop were mentioned, including the reason the man was pulled over to begin with.

It appears police may have conducted a search of his vehicle, as he now stands charged with felony third-degree possession of a controlled substance. He also faces misdemeanor charges of possession of a hypodermic instrument and criminal possession of a controlled substance. The type of drug police say they found is still not being released to the public.

Too little information is available pertaining to this case to make a determination around how it will go when brought before a New York court. The man’s criminal defense team will carefully review all the facts of the case, including information that was not made public, to determine whether any search conducted of the man’s person or vehicle was done in accordance with his rights as an American citizen. If breach of protocol is discovered at any step of this process, the charges could be reduced or the case thrown out altogether.
