Criminal defense: Driver charged in motorcycle crash

A motorcyclist was tragically killed after reportedly being struck by a vehicle in the early morning of May 27, according to local sources. New York police say they have arrested the driver of the vehicle for suspected drunk driving. So far, no court date has been announced, and it is unclear whether the driver has retained criminal defense counsel at this time. 

According to the report, around 3:55 a.m. a 28-year-old motorcyclist was making a left turn on Ocean Parkway in Brooklyn. A 24-year-old woman in a car was driving northbound when she apparently struck the man. He was thrown from his motorcycle and rushed to a local hospital with critical injuries, and was pronounced dead shortly thereafter. 

The driver of the car stayed at the scene of the accident, where she was arrested on suspicion of drunk driving. She is also charged with vehicular manslaughter and driving without a license. While she was uninjured in the crash, four other people in her car suffered minor injuries. 

Drunk driving is taken very seriously by New York courts, and if the woman is found guilty, she could face serious jail time as well as the revocation of her license. However, no information was included in the report about how officers on the scene made the determination that she had been drinking. Prosecutors will have to provide sufficient evidence of her alleged intoxication in order to convict her.
