Criminal defense: New York man faces DUI charges

A man is facing serious charges after his vehicle reportedly severed a woman’s leg, according to local sources. New York Police Department officers in Tribeca responded to the accident and arrested the 27-year-old driver.  So far, no court date has been announced, and it is unclear whether the man has retained criminal defense counsel at this time. 

According to the limited information provided in the report, it is suspected that the 27-year-old man may have been intoxicated around 10 p.m. the night of May 10. The report says the man attempted to make a high-speed U-turn in an intersection. Unfortunately, the 42-year-old female victim and a man, aged 20, were also in the intersection at the time. The man suffered minor injuries, but the woman was pinned to a utility pole by the driver’s car. 

Emergency crews were able to free her from the wreckage, but the impact had severed her leg below the knee. She was rushed to a local hospital, where she is listed as being in stable condition. The driver has been arrested and charged with failure to yield to a pedestrian, reckless driving and driving while intoxicated. 

It will be up to New York prosecutors to prove beyond a reasonable doubt that the man driving at the time of the accident was indeed drunk or otherwise impaired behind the wheel. This could require considerable evidence to be brought forth by the prosecution. The man’s criminal defense team will carefully review any such evidence to assess its admissibility and raise any factual or legal issues on the man’s behalf in court.
