Criminal defense: 3 arrested in alleged home invasion

Three men in Farmington face federal court indictment in connection with a home invasion in 2016 in which one man was killed. The New York men, aged 51, 48 and 39, have been charged with conspiracy to commit robbery. If they are found guilty, they could face years in prison, significant fines and other consequences. For the moment, no court date has been announced and it is unclear whether any of the three men have retained criminal defense representation. 

The report alleges that back in July 2016, the three men along with several others conspired together to rob the home of a 26-year-old man. The man was believed to be in possession of controlled substances. The 51-year-old man, together with a fourth man aged 29, allegedly broke into the residence carrying knives and a baseball bat. A neighbor reportedly heard the disturbance and went to the apartment, at which point an altercation apparently broke out. 

In the ensuing confusion, the 26-year-old man shot and killed the 29-year-old. He is now serving 13 years in prison for gun and drug charges. However, at the time of the incident he allegedly gave a bag of cocaine and a bag of oxycodone to the 51-year-old. It is not clear how the other two men factored into this altercation, though it appears from the charges they helped to plan it. 

The three men could each face up to 20 years in federal prison if they are found guilty, not to mention fines of up to $250,000 each. It will be up to federal prosecutors in New York to prove the involvement of all three accused individuals in this alleged crime. They will each be represented by a criminal defense attorney who will carefully scrutinize all of the evidence the prosecution brings forward to help build a compelling defense for his or her client.
